SGWatchMart Terms and Conditions of Use

Welcome to SGWatchMart ("the Platform”). These Terms and Conditions ("Terms”) govern your access to and use of the website, mobile applications, and services provided by SGWatchMart ("we”, "us”, or "our”).

By registering an account, listing a timepiece, making an offer, or browsing the Platform, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree, please discontinue use of the Platform immediately.

1. Nature of the Platform (Venue Only)

1.1 Intermediary Role: SGWatchMart is a digital marketplace that provides a venue for private individuals and commercial boutique dealers ("Sellers”) to list luxury watches for sale, and for interested parties ("Buyers”) to browse and make inquiries.

1.2 No Party to Transactions: SGWatchMart is not an auctioneer, a luxury watch dealer, or a party to any actual transaction, negotiation, or contract formed between Buyers and Sellers.  We do not take ownership, possess, inspect, verify, deliver, or guarantee any watch listed on the Platform.

1.3 Independent Contracts: Any agreement to buy or sell a watch is concluded strictly and privately between the Buyer and the Seller. SGWatchMart explicitly disclaims all liability arising out of or in connection with such private agreements.

2. User Accounts & Eligibility

2.1 Age Requirement: You must be at least 18 years of age to create an account or utilize our services.

2.2 Account Security: You are solely responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

2.3 Accuracy of Information: You agree to provide true, accurate, and complete registration data. You must not impersonate any person or entity or misrepresent your affiliation with any brand or dealer business.

3. Marketplace Rules for Sellers

3.1 Authenticity Warranty: Sellers strictly warrant that any watch they list on the Platform is authentic, legally owned by them, and free from any liens, encumbrances, or theft reports. The listing or sale of counterfeit, replica, or cloned timepieces is strictly prohibited.

3.2 Accurate Representation: Listings must include actual, unaltered photographs of the specific watch for sale. Descriptions, including condition ratings (e.g., Mint, Unworn, Pre-owned), box/papers availability, and service history, must be completely transparent and accurate.

3.3 Compliance with Anti-Scam Guidelines: In alignment with Singapore's e-commerce guidelines (TR 76), we reserve the right to perform due diligence checks, verify identity records, and immediately suspend or terminate listings or accounts flagged for suspicious or fraudulent behavior.

4. Marketplace Rules for Buyers

4.1 Due Diligence: Buyers acknowledge that they are solely responsible for conducting their own due diligence, checking authenticity, verifying seller reputation, and inspecting the timepiece before finalizing any financial transaction.

4.2 In-Person Transactions: For P2P transactions within Singapore, we strongly encourage Buyers and Sellers to meet face-to-face at secure, public locations or authorized watch service centers to verify authenticity and physical condition before completing payment.

5. Fees and Subscription Models

5.1 Listing Fees: SGWatchMart may charge fees for specialized listings, premium banner spaces, or dealer subscription tiers. All fees will be explicitly stated before publishing a listing.

5.2 Non-Refundability: Unless explicitly stated otherwise or required under Singapore consumer protection laws, all fees paid to SGWatchMart for platform utility, bumps, or promotional features are strictly non-refundable.

6. Intellectual Property

6.1 Platform Ownership: All materials, layout, code, software, graphics, and logos (including the "SGWatchMart" brand) are the exclusive property of SGWatchMart or its licensors.

6.2 User-Generated Content: By uploading images, text, or specifications to create a listing, you grant SGWatchMart a non-exclusive, worldwide, royalty-free, perpetual license to use, display, modify, and reproduce such content for operational and promotional purposes across our digital channels.

7. Limitation of Liability & Disclaimers

7.1 "As-Is" Platform: The Platform is provided on an "as-is" and "as-available" basis without warranties of any kind, whether express or implied.

7.2 No Liability for User Conduct: SGWatchMart shall not be liable for any damages, monetary losses, fraud, or disputes arising from user misconduct, counterfeit products, inaccurate listings, or unsuccessful transactions between buyers and sellers.

7.3 Maximum Liability Cap: To the maximum extent permitted under Singapore law, our total aggregated liability to you for any claims arising out of the use of the Platform shall not exceed the total amount of fees you paid to us in the three (3) months preceding the claim event.

8. Indemnity

You agree to indemnify, defend, and hold harmless SGWatchMart, its directors, employees, and affiliates from and against any third-party claims, liabilities, losses, damages, or costs (including legal fees) arising from your breach of these Terms, your misuse of the Platform, or your violation of any laws or the rights of another user (including trademark or copyright infringement).

9. Modifications to Terms

We reserve the right to amend, update, or modify these Terms at any time at our sole discretion.  Revised versions will be posted on this page with an updated "Last Updated" date.  Your continued use of the Platform after changes are published constitutes your explicit acceptance of the revised Terms.

10. Governing Law & Jurisdiction

These Terms shall be governed by, construed, and enforced in accordance with the Laws of the Republic of Singapore . Any dispute arising out of or in connection with these Terms, including any question regarding its existence, validity, or termination, shall be referred to and finally resolved by the courts of Singapore.
